Couple arrested in Rehoboth Beach domestic dispute in which gun fired

REHOBOTH BEACH — Delilah Boyer, a 21-year-old from Harrington, and her 21-year-old boyfriend Marvin Burton, of Rehoboth Beach, were both arrested following a domestic incident in which a gun was discharged on Thursday, Delaware State Police said.

Police were dispatched to the 37000 block of Johnson Street in Rehoboth Beach at around 11:10 a.m. for a report of a domestic incident.

When they arrived, they located a 19-year-old male victim with injuries.

Police discovered that the 19-year-old was visiting his mother’s residence on Johnson Street, when his sister, Ms. Boyer, and Mr. Burton showed up at the residence.

Mr. Burton got out of a vehicle and confronted the teenager, which led to a fight.

Mr. Burton went back to the vehicle, at which time Ms. Boyer – who was still in the driver’s seat – placed the vehicle in drive and accelerated towards her brother, missing him along with her other 22-year-old and 15-year-old brothers.

However, Ms. Boyer struck a tree, which caused the front windshield and passenger window to shatter. She then got out of the vehicle and began screaming and yelling.

Police said Mr. Burton then got a handgun from the glove box and a struggle between him and the 19-year-old ensued as Mr. Burton struck then teenager in the head with the handgun.

While the two struggled over the gun, the weapon fired and the teenager was able to take possession of the magazine.

Meanwhile, Ms. Boyer’s 50-year-old mother came out of her residence, at which time the daughter and mother started to fight.

Mr. Burton and Ms. Boyer eventually got back in their vehicle and fled the scene.

Troopers located the vehicle, a silver Kia Sol, along with the sole occupant, Ms. Boyer, in the subdivision of Aspen Meadows off Munchy Branch Road in Rehoboth Beach.

Troopers located Mr. Burton a short time later at his residence in the 35000 block of East Atlantic Circle, where he was taken into custody without incident.

The 19-year-old male victim was taken by ambulance to a local area hospital where he was treated and released. The 22-year-old and 15-year-old male victims were not injured. The 50-year-old victim sustained minor injuries but declined medical treatment.

Police located a magazine for a .40 caliber handgun loaded with bullets at the scene. A search warrant was later executed on Mr. Burton’s residence, which led to the discovery of .40 caliber ammunition and a leather holster.

Mr. Burton was charged with: possession of a firearm during the commission of a felony; two counts of possession of a firearm or ammunition by a person prohibited; second-degree assault; first-degree reckless endangerment and second-degree conspiracy.
He was committed to the Sussex Correctional Institution in Georgetown on $100,000 cash-only bond.

Ms. Boyer was charged with: three counts of possession of a deadly weapon during the commission of a felony; three counts of aggravated menacing; second-degree conspiracy and third-degree assault.

She was committed to the Delores J. Baylor Women’s Correctional Institution in New Castle on $80,000 secured bond.
