Middletown man charged with felony DUI in Dover

DOVER — A 41-year-old Middletown man was arrested on a felony drunken driving charge after a vehicle stop early Saturday morning, according to an arrest affidavit.

Anibal P. Lopez was initially seen driving a silver colored passenger vehicle at 1:46 a.m. on U.S. 13 just north of White Oak Road, according to Dover Police.

Mr. Lopez then performed a pre-exit and standardized field sobriety tests, the arresting officer wrote in court documents.

A records search found that Mr. Lopez was convicted of DUI on Oct. 3, 2006 and June 2, 2008.

A Dover Police intoxilyzer test indicated Mr. Lopez had a blood alcohol concentration of .165 percent, according to authorities.

A .08 percent finding is the minimum threshold for drunken driving in Delaware.

Mr. Lopez was charged with a third offense driving under the influence of alcohol. He was presented at Justice of the Peace Court 7 in Dover and given a $5,000 unsecured hearing. A preliminary hearing was scheduled for Friday morning in the Kent County Court of Common Pleas.
